General Terms and Conditions

1) Scope

1.1 These General Terms and Conditions (hereinafter “GTC”) of Ing. Wolfgang Kanduth, MBA MPA Msc, operating under "Meisterdrucke" (hereinafter “Seller”), apply to all contracts for the supply of goods which a consumer or entrepreneur (hereinafter “Customer”) concludes with the Seller regarding the goods presented by the Seller in its online shop. The inclusion of the Customer’s own terms and conditions is hereby rejected unless otherwise agreed.

1.2 For the purposes of these GTC, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur, within the meaning of these GTC, is a natural or legal person or a partnership with legal capacity, acting in the exercise of their commercial or self-employed professional activity when entering into a legal transaction.



2) Conclusion of Contract

2.1 The product descriptions contained in the Seller’s online shop do not constitute binding offers by the Seller but serve for the submission of a binding offer by the Customer.

2.2 The Customer may submit the offer via the online order form integrated into the Seller’s online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the Customer submits a legally binding offer to conclude a contract regarding the goods contained in the shopping cart by clicking the button concluding the order process.

2.3 The Seller may accept the Customer’s offer within five days by:


sending a written order confirmation or an order confirmation in text form (fax or e-mail), where receipt of the order confirmation by the Customer is decisive, or


delivering the ordered goods to the Customer, where receipt of the goods by the Customer is decisive, or


requesting payment from the Customer after receipt of the order.

If several of the aforementioned alternatives apply, the contract is concluded at the time when one of the alternatives occurs first. The period for accepting the offer begins on the day after the Customer sends the offer and ends with the expiry of the fifth day following the submission of the offer. If the Seller does not accept the Customer’s offer within the aforementioned period, this shall be deemed a rejection of the offer with the consequence that the Customer is no longer bound by their declaration of intent.

2.4 When submitting an offer via the Seller’s online order form, the contract text is stored by the Seller after conclusion of the contract and sent to the Customer in text form (e.g. e-mail, fax, or letter) after submission of their order. Any further accessibility of the contract text by the Seller is not provided. If the Customer has created a user account in the Seller’s online shop before submitting their order, the order data is archived on the Seller’s website and can be accessed by the Customer free of charge via their password-protected user account by entering the corresponding login data.

2.5 Before submitting the binding order via the Seller’s online order form, the Customer can identify possible input errors by carefully reading the information displayed on the screen. An effective technical means for better recognition of input errors may be the browser’s magnification function, with which the display on the screen is enlarged. During the electronic order process, the Customer can correct their entries using the usual keyboard and mouse functions until they click the button concluding the order process.

2.6 The contract is concluded in German and English.

2.7 Order processing and contact usually take place by e-mail and automated order processing. The Customer must ensure that the e-mail address provided by them for order processing is correct so that e-mails sent by the Seller can be received at this address. In particular, when using SPAM filters, the Customer must ensure that all e-mails sent by the Seller or by third parties commissioned with order processing can be delivered.




3) Right of Withdrawal

3.1 Consumers generally have a right of withdrawal.

3.2 More detailed information on the right of withdrawal can be found in the Seller’s cancellation policy.

3.3 The right of withdrawal does not apply to consumers who, at the time the contract is concluded, do not belong to a member state of the European Union and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.



4) Prices and Payment Conditions

4.1 Unless otherwise stated in the Seller’s product description, the prices quoted are total prices including statutory VAT. Any additional delivery and shipping costs are stated separately in the respective product description.

4.2 For deliveries to countries outside the European Union, additional costs may arise in individual cases which are not the responsibility of the Seller and must be borne by the Customer. These include, for example, costs for transferring money by credit institutions (e.g. transfer fees, exchange rate charges) or import duties or taxes (e.g. customs duties). Such costs may also arise in relation to money transfers if the delivery is not made to a country outside the European Union, but the Customer makes the payment from a country outside the European Union.

4.3 The payment option(s) will be communicated to the Customer in the Seller’s online shop.

4.4 If prepayment by bank transfer has been agreed, payment is due immediately upon conclusion of the contract, unless the parties have agreed otherwise.

4.5 If payment is made using a payment method offered by PayPal, payment is processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: “PayPal”), subject to the PayPal Terms of Use, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or – if the Customer does not have a PayPal account – subject to the terms for payments without a PayPal account, available at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full.

4.6 If the payment method “SOFORT” is selected, payment is processed via the payment service provider SOFORT GmbH, Theresienhöhe 12, 80339 Munich (hereinafter “SOFORT”). To pay the invoice amount via “SOFORT,” the Customer must have an online banking account enabled for participation in “SOFORT” with PIN/TAN procedure, legitimize themselves during the payment process, and confirm the payment order to “SOFORT.” The payment transaction will then be carried out immediately by “SOFORT” and the Customer’s bank account will be debited. Further information on the “SOFORT” payment method can be found online at https://www.klarna.com/sofort/.



5) Delivery and Shipping Conditions

5.1 The delivery of goods is made by shipping to the delivery address specified by the Customer, unless otherwise agreed. For the execution of the transaction, the delivery address specified in the Seller’s order processing is decisive.

5.2 If the transport company returns the dispatched goods to the Seller because delivery to the Customer was not possible, the Customer bears the costs for the unsuccessful shipment. This does not apply if the Customer is not responsible for the circumstance that led to the impossibility of delivery, or if they were temporarily prevented from accepting the offered service, unless the Seller had announced the service a reasonable time in advance. Furthermore, this does not apply to the shipping costs if the Customer effectively exercises their right of withdrawal. In case of effective exercise of the right of withdrawal by the Customer, the provision made in the Seller’s cancellation policy applies to the return costs.

5.3 In the case of self-collection, the Seller first informs the Customer by e-mail that the goods ordered by them are ready for collection. After receiving this e-mail, the Customer may collect the goods from the Seller’s place of business after consultation with the Seller. In this case, no shipping costs will be charged.



6) Retention of Title

If the Seller makes an advance payment, they retain title to the delivered goods until the purchase price owed has been paid in full.



7) Liability for Defects (Warranty)

7.1 If the purchased item is defective, the provisions of the statutory liability for defects shall apply.

7.2 The Customer is requested to report delivered goods with obvious transport damage to the carrier and inform the Seller accordingly. Failure to do so has no effect on the Customer’s statutory or contractual claims for defects.



8) Special Conditions for Processing Goods According to Customer Specifications

8.1 If, according to the content of the contract, the Seller owes not only the delivery of goods but also the processing of the goods according to certain specifications of the Customer, the Customer must provide the Seller with all content required for processing, such as texts, images or graphics, in the formats, formatting, image and file sizes specified by the Seller and grant the Seller the necessary rights of use. The Customer is solely responsible for the procurement and acquisition of rights to these contents. The Customer declares and assumes responsibility for having the right to use the contents provided to the Seller. In particular, the Customer ensures that no third-party rights are infringed, especially copyright, trademark, and personal rights.

8.2 The Customer indemnifies the Seller against claims by third parties which they may assert against the Seller in connection with an infringement of their rights by the contractual use of the Customer’s content by the Seller. The Customer also assumes the reasonable costs of necessary legal defense, including all court and attorney’s fees at the statutory rate. This does not apply if the Customer is not responsible for the infringement. In the event of a claim by a third party, the Customer is obliged to immediately, truthfully and completely provide the Seller with all information necessary to examine the claims and for defense.

8.3 The Seller reserves the right to refuse processing orders if the content provided by the Customer violates legal or official prohibitions or morality. This applies in particular to the provision of content that is anti-constitutional, racist, xenophobic, discriminatory, offensive, harmful to minors, and/or glorifies violence.



9) Redemption of Promotional Vouchers

9.1 Vouchers issued by the Seller free of charge as part of promotions with a certain validity period and which cannot be purchased by the Customer (hereinafter “promotional vouchers”) can only be redeemed in the Seller’s online shop and only within the specified period.

9.2 Individual products may be excluded from the voucher promotion, provided that a corresponding restriction arises from the content of the promotional voucher.

9.3 Promotional vouchers can only be redeemed before the completion of the order process. Subsequent offsetting is not possible.

9.4 Only one promotional voucher can be redeemed per order.

9.5 The value of the goods must at least equal the amount of the promotional voucher. Any remaining balance will not be refunded by the Seller.

9.6 If the value of the promotional voucher is insufficient to cover the order, one of the remaining payment methods offered by the Seller may be selected to settle the difference.

9.7 The balance of a promotional voucher will not be paid out in cash nor bear interest.

9.8 The promotional voucher will not be refunded if the Customer returns the goods paid for in full or in part with the promotional voucher within the scope of their statutory right of withdrawal.

9.9 The promotional voucher is transferable. The Seller can render performance with discharging effect to the respective holder who redeems the promotional voucher in the Seller’s online shop. This does not apply if the Seller has knowledge or grossly negligent ignorance of the lack of entitlement, incapacity, or lack of power of representation of the respective holder.



10) Applicable Law

All legal relations between the parties shall be governed by the law of the Republic of Austria, excluding the laws on the international purchase of movable goods. For consumers, this choice of law applies only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has their habitual residence.



11) Code of Conduct

The Seller has submitted to the terms of participation for the eCommerce initiative "Fairness in Commerce", which can be viewed online at https://www.fairness-im-handel.de/teilnahmebedingungen/.



12) Alternative Dispute Resolution

12.1 The EU Commission provides a platform for online dispute resolution at the following link: https://ec.europa.eu/consumers/odr

This platform serves as a contact point for out-of-court resolution of disputes arising from online purchase or service contracts involving a consumer.

12.2 The Seller is not obliged to participate in dispute resolution proceedings before a consumer arbitration board, but is generally prepared to do so.



13) Terms of Use

13.1 All images published on our website may not be copied, further processed or published elsewhere.

13.2 The use of our printed works is permitted exclusively for the private purpose of furnishing and interior decoration. Any other use, such as further utilization or commercial use, is not permitted.

13.3 The printed works may only be exhibited in private premises. Public exhibitions are not permitted.



14) Duties of the Customer

14.1 The processing of image material supplied by the Customer is carried out within the framework of an automated procedure without verification or correction by the Seller. By uploading files, the Customer confirms that they have the right to distribute and reproduce the contents and materials of this file, in particular that they possess the necessary copyright rights and, if applicable, have the consent of the persons depicted as per § 22 German Copyright Act.

14.2 In particular, the Customer guarantees that the uploaded image file does not contain content glorifying violence, inciting hatred, racist, pornographic or child-pornographic content. The Customer further confirms that no laws for the protection of minors or criminal laws are violated and that the templates do not infringe any copyright, trademark or other proprietary rights of third parties, general personal rights, or any other rights.

14.3 Should the Seller be held liable by third parties for injunction, damages or otherwise as a result of the processing of an image uploaded by the Customer, the Customer is obliged to indemnify the Seller against such claims.

14.4 The Customer confirms that they will use the image exclusively for private, decorative use.
